Terms & Conditions
These Terms & Conditions apply to bookings, memberships, class passes, classes, courses, workshops, events and other services provided by Sadhana Cheshire Ltd (“Sadhana”, “we”, “us” or “our”).
Sadhana Cheshire Ltd is registered in England and Wales under company number 17184975, with its registered office at 31 Kestrel Close, Congleton, Cheshire, CW12 3FA.
Our studio is located at Sadhana Cheshire, Gawsworth Business Court, Shellow Lane, Gawsworth, Congleton, CW12 2FQ. You can contact us at Sadhanacongleton@gmail.com
These terms should be read alongside:
- our Cancellation & Booking Policy;
- our Privacy Notice;
- our Photography & Filming Policy;
- any relevant health, participation or parental consent form; and
- any specific terms displayed when purchasing a membership, class pass, course, workshop, event or other service.
These documents are available on our Sadhana booking platform or app. They form part of the agreement between the customer and Sadhana.
Before completing a booking or purchase, customers will be given the opportunity to review the relevant terms and policies. By completing the booking or purchase, the customer agrees to the terms presented during that process.
Bookings
Bookings should be made through Sadhana’s approved booking platform or another method agreed by Sadhana.
All places are subject to availability. A booking is confirmed once it has been accepted by Sadhana and any required payment has been received.
Customers are responsible for ensuring that their contact, health and booking information is accurate and kept up to date.
Bookings may not be transferred to another person unless the applicable booking or pass terms permit this or Sadhana has agreed to the transfer in advance.
Payments
The price and payment arrangements for each service will be displayed before purchase.
Fees must be paid in accordance with the applicable booking, membership or pricing terms.
We may change prices for future bookings and purchases. A price change will not retrospectively affect a class, pass, course, workshop, event or other service that has already been paid for.
Where we propose to change the price of an ongoing membership, we will give reasonable advance notice. If a price increase materially disadvantages a member, they may cancel the membership before the new price takes effect, subject to any minimum term that was clearly agreed when the membership was purchased.
Memberships & Passes
Memberships, class passes and booking credits:
- are for the named customer unless the relevant product terms state otherwise or Sadhana agrees to a transfer;
- must be used within any stated validity period;
- cannot be exchanged for cash;
- are subject to the applicable booking, cancellation, late-arrival and no-show rules; and
- may be subject to limits concerning the number or type of classes that can be booked.
The following information will be displayed on the Sadhana booking platform or app before purchase:
- the price;
- the services or number of sessions included;
- the validity or membership period;
- the payment frequency;
- any minimum commitment;
- whether the product renews automatically;
- what happens to unused sessions or credits;
- any freezing or suspension arrangements; and
- how and when the membership may be cancelled.
These product-specific terms form part of the customer’s agreement with Sadhana.
Cancellations, No-Shows and Late Arrival
All bookings are subject to Sadhana’s Cancellation & Booking Policy, which is available on our website and through the Sadhana booking platform or app.
Studio Schedule & Changes
Sadhana may occasionally need to:
- change a teacher;
- alter the timetable;
- substitute an appropriate class;
- change the location of a session; or
- cancel or reschedule a class, course, workshop or event.
We will give as much notice as reasonably possible.
A change of teacher or a minor timetable adjustment will not normally entitle a customer to a refund.
Where Sadhana cancels a paid session, we will restore the affected booking credit or offer an appropriate transfer. Where no reasonably suitable alternative is available, a refund will be provided where appropriate or required by law, in accordance with the booking type and our Cancellation & Booking Policy.
If Sadhana makes a substantial or continuing reduction to the services included in an ongoing membership, we will consider an appropriate adjustment and any right the member may have to cancel.
Health & Participation
Physical activity involves inherent risks. Sadhana’s classes and services do not constitute medical advice or replace assessment, diagnosis or treatment by an appropriately qualified healthcare professional.
Customers are responsible for considering whether a class or activity is suitable for them. Before participating, customers should tell the teacher about any injury, pregnancy, health condition or other circumstance that is reasonably relevant to safe participation.
Participants should:
- follow reasonable safety instructions;
- use equipment only as instructed;
- work within their own abilities; and
- stop and tell the teacher if they experience pain, faintness, dizziness, unusual shortness of breath or significant discomfort.
We may recommend that a customer obtains appropriate medical advice before participating. We may also refuse or stop participation where we reasonably believe that continuing would present a risk to the participant or others.
Sadhana and its teachers will continue to exercise reasonable care and skill when providing services.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a customer’s statutory rights.
Health information will be handled in accordance with our Privacy Notice.
Reformer Pilates
Participants must follow all instructions concerning the use and adjustment of Reformer equipment.
Customers should book a class suitable for their experience and tell the teacher if they are new to Reformer Pilates or have any relevant injury, health condition or pregnancy.
Sadhana may refuse or stop participation where it reasonably considers that continuing would be unsafe.
Late entry to a Reformer class is not guaranteed where the participant has missed essential safety information or the warm-up. The treatment of any payment or booking credit will be determined in accordance with our Cancellation & Booking Policy.
Children & Young People
A child or young person may attend only once Sadhana has received the required parent or guardian consent and any relevant:
- health and emergency information;
- allergy or medication information;
- additional support information; and
- authorised collection details.
The person making a booking for a child confirms that they have parental responsibility for the child or have been authorised to make the booking by someone who does.
Parents and guardians are responsible for ensuring that the information provided is accurate and for telling Sadhana promptly about any relevant changes.
Separate arrangements may apply to:
- parent-and-child or family classes;
- children’s term-time classes;
- drop-off sessions;
- holiday clubs; and
- workshops or special events.
The applicable supervision, collection, booking and cancellation arrangements will be displayed during the booking process or provided in the relevant parent or guardian information.
Consent to photography or filming is optional and will be managed separately under our Photography & Filming Policy.
Behaviour & Respect
Everyone attending Sadhana is expected to behave respectfully towards teachers, staff, other participants and visitors.
Sadhana may refuse admission, stop participation or require someone to leave where it reasonably believes their behaviour is:
- abusive;
- threatening;
- discriminatory;
- unsafe; or
- seriously disruptive.
We will apply this provision fairly and will consider reasonable adjustments where relevant.
No refund or restored credit will ordinarily be provided where a person is required to leave because of their own serious misconduct, subject to their statutory rights and the particular circumstances.
Personal Belongings
Customers are responsible for taking reasonable care of their personal belongings.
We cannot guarantee the security of items brought into the studio. Sadhana will be responsible for loss or damage only where it results from our negligence, breach of contract or another liability that cannot legally be excluded.
Photography & Filming
Photography and filming will be handled in accordance with Sadhana’s Photography & Filming Policy and the relevant consent arrangements.
We will obtain separate appropriate consent before using identifiable photographs or recordings for marketing purposes. Separate parental or guardian consent will be required for children and young people.
Choosing not to give photography or filming consent will not prevent someone from accessing Sadhana’s ordinary services.
Privacy
Personal information will be collected, used, stored and shared in accordance with Sadhana’s Privacy Policy.
This includes information provided through the website, booking platform, health and participation forms, children’s forms and emergency contact arrangements.
Website & Published Information
We make reasonable efforts to ensure that class descriptions, schedules, prices and other published information are accurate.
Minor errors and changes may occasionally occur. Where an error materially affects a booking or purchase, we will take reasonable steps to correct it and offer an appropriate remedy.
Statutory Cancellation Rights
Customers purchasing certain memberships, passes or services online or by telephone may have a statutory right to cancel the contract within 14 days.
Different rules may apply to classes, workshops, courses or events booked for a specific date or period. Where a statutory cancellation right applies, details of that right, how to exercise it and any payment due for services already provided will be made available during the purchase process and in the booking or purchase confirmation.
Nothing in these terms restricts any statutory cancellation right that applies to a customer.
Complaints
If a customer has a concern or complaint, they should contact Sadhana at sadhanacongleton@gmail.com
We will aim to acknowledge a formal complaint within five working days and provide a full response within 14 working days. Where more time is reasonably required, we will explain the reason and provide an expected response date.
Nothing in this complaints process prevents a customer from exercising their statutory rights or pursuing another remedy available to them.
Statutory Rights
Nothing in these terms affects the rights customers have under the Consumer Rights Act 2015, the Consumer Contracts Regulations or any other applicable consumer law.
Governing Law & Jurisdiction
These terms and any agreement between a customer and Sadhana are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction over disputes relating to these terms. However, a consumer who lives elsewhere in the United Kingdom will retain the benefit of any mandatory protections provided by the law of the part of the United Kingdom in which they live and may bring proceedings in their local courts where legally permitted.
Changes to These Terms
We may update these terms for future bookings and purchases. The version accepted when a booking or purchase is made will ordinarily apply to that transaction.
For an ongoing membership, we may make reasonable changes for legal, regulatory, safety or operational reasons. We will provide reasonable notice of any material change.
If a change materially disadvantages a member, they may cancel before it takes effect without an additional cancellation charge, subject to any minimum membership term that was clearly disclosed and agreed at purchase.
